Empthrive Order Request Terms

General Terms

By submitting an order request through Empthrive Checkout (“Empthrive Checkout”), via the Empthrive Website (“the Site”), you agree to be bound by the following Empthrive ("Empthrive", "we", "us" or the "Company") Checkout Order Request Terms. By using the Empthrive Site, you also agree to be bound by all policies set out on the Empthrive Website, www.Empthrive.com, including the following:

Empthrive may, in its sole discretion, revise the Empthrive Checkout Order Request Terms from time to time, and it is your responsibility to review the Empthrive Checkout Order Request Terms each time you submit an order request through Empthrive Checkout. Empthrive may, in its sole discretion, revise the additional policies listed above, and it is your responsibility to review those policies each time you use Empthrive Checkout. Your continued use of the Empthrive Site, or your submission of an order request through Empthrive Checkout, constitutes your agreement to any such modifications.

How Empthrive Order Requests Work
Order requests submitted through Empthrive’s platform may be either directly fulfilled by Empthrive or through our third-party partners (“Partners”) who provide consultation services and professional resources through a referral from Empthrive.

Empthrive offers two service streams:

(1) Empthrive Services: Direct consultation and support provided by Empthrive.

(2) Partner Services: Consultation and support provided by our third-party Partners, through a referral from Empthrive.

After submitting your service request, Empthrive will determine which service stream is best suited to your needs. If necessary, your request may be referred to an identified Partner for their services. The Partner will be the sole party responsible for fulfilling the request and providing the services to you. Each Partner is responsible for compliance with all applicable laws, regulations, and their own terms of service.

These Sales and Checkout Terms govern your relationship with Empthrive, but you must consult the specific Partner’s website or terms for additional terms, conditions, or policies that may apply to your purchase or use of services from the Partner. By submitting an order or service request through the Empthrive platform, you agree to any and all applicable Partner policies, in addition to those outlined by Empthrive.

If your service request is referred to a Partner, the Partner will review your request and may accept or reject it. If accepted, your payment will be processed, and the Partner will provide the requested services in accordance with both these Sales and Checkout Terms and the Partner’s own terms and policies. The Partner may reject the order or request for any reason, including but not limited to service availability, compliance with applicable laws, or issues stated in the Partner’s policies. Please refer to the Partner’s specific policies for further information.

Order Cancellation Policy
If you wish to cancel your service request, you must notify Empthrive within twenty-four (24) hours of submitting your request by contacting us via our "Contact Us" option on the platform or by emailing us at hello@empthrive.com. Cancellation requests received on Saturday or Sunday may not be processed until the following business day.

Cancellation requests submitted after the twenty-four (24) hour period will be considered at Empthrive’s discretion, whether the service is provided directly by Empthrive or by a third-party Partner (if applicable), and may be subject to additional terms or fees. However, such requests must be submitted no later than seven (7) days after the original service request, and only if the requested consultation or service is scheduled for a future date and is not within three (3) days of your original request.

If your service request involves an appointment and that appointment has already been scheduled or fulfilled (i.e., the consultation or service has already taken place or is imminent), the request for cancellation will no longer be considered, even if you notify Empthrive within the twenty-four (24) hour window.

If your service request is handled directly by Empthrive, the cancellation will be processed by us. If your request is referred to a third-party Partner, please consult the Partner’s own cancellation policies, as they may impose specific terms or fees. In cases of cancellation beyond the twenty-four (24) hour period, the Partner may charge a cancellation or change fee (if applicable), in accordance with their own policies. We encourage you to contact Empthrive as soon as possible if you wish to cancel your request.

Your Order Information
To submit a service request ("Order", "Order Request") through Empthrive’s platform, you will be required to provide necessary information, including payment, billing, shipping and service details. Please ensure all provided information is correct and accurate, as errors may delay the service process. The billing address you provide must match the address associated with your payment method. If you provide a different address for service-related purposes (e.g., for the consultation or to receive any related materials), please ensure this information is correct and up-to-date.

Once your service request has been submitted and accepted by Empthrive or the relevant Partner, and the twenty-four (24) hour cancellation period has expired, changes to this information may not be possible. If changes are allowed, additional fees or penalties may apply, as determined by Empthrive or the Partner. For further details regarding changes or cancellation policies, please consult Empthrive's policies or the relevant Partner's policies.

Representation of Legal Age for Services
Empthrive’s Services are intended for adults who meet the legal age requirements in their jurisdiction. By submitting a service request, you represent and warrant that you are of legal age to access the services in your jurisdiction. In particular, certain consultation services offered by Empthrive may be subject to specific age requirements, including but not limited to services related to mental health, legal advice, or other regulated professional services.

If any consultation service you request is subject to age restrictions under Irish or EU law, you confirm that you meet the applicable age requirements. Empthrive reserves the right to verify your age if necessary, to comply with applicable regulations and laws in Ireland and the EU.

Service Delivery Location
Empthrive primarily offers digital consultation services, unless otherwise specified (e.g., attendance at events or in-person sessions). For digital services, the service will be delivered to you remotely, via online platforms, emails, or virtual meetings, depending on the nature of the consultation.

In the case of a service being provided in person or at a specific location (such as through one of Empthrive's Partners), this will be clearly communicated and confirmed with you prior to the appointment. The location and delivery method of such services will be subject to the Partner’s terms and conditions, and any applicable location-based requirements will be outlined at the time of booking. Please ensure that the information you provide is correct and up-to-date. Once your service request has been accepted by Empthrive or the relevant Partner, changes to service details may not be possible. In case the service cannot be delivered as planned (e.g., due to incorrect information or inability to attend), additional fees may apply.

For services involving physical goods (if applicable), shipping fees will be communicated to you before finalising the service request. The fees and policies associated with such shipments are subject to the relevant terms and will be made clear at the time of purchase or service request.

Please consult the specific Partner’s or Empthrive’s website for additional terms, conditions, or policies that may apply to the delivery of services or physical items.

Impacts of External Factors on Service Delivery
Empthrive’s core services are delivered digitally, and weather conditions or external factors generally will not impact your access to services. However, in the event of extraordinary circumstances or unforeseen disruptions (e.g., technical issues, natural disasters, political instability, or emergencies) that may affect the ability of Empthrive or our Partners to fulfill digital or in-person consultations or services, Empthrive will make every reasonable effort to notify you of any delays or cancellations.
If your service request involves an in-person or location-specific consultation with one of our Partners, you will be notified if external factors beyond our Partner's control cause delays or cancellations. In such cases, our Partner will contact you directly to discuss rescheduling or alternative arrangements.
If you wish to delay or reschedule your service due to personal reasons or extraordinary circumstances, please reach out to Empthrive Customer Service as soon as possible. Any request for delay or rescheduling will be subject to availability and must be coordinated with the relevant Partner, in accordance with their terms and conditions and our cancellation policy.

For services delivered digitally (e.g., virtual consultations) by Empthrive, delays due to weather conditions or technical issues are generally unlikely but may occur. If such delays happen, we will notify you and offer rescheduling options as needed.

Payment
When submitting a service request through Empthrive, payment will be processed through the payment information you provide. Depending on the nature of the service (whether directly provided by Empthrive or via a Partner), the payment may be processed by Empthrive or the relevant Partner. You will be notified of which party will process the payment prior to completing your request.

By providing payment information, you represent and warrant that you have the legal right to use the payment method (e.g., credit card) for the transaction initiated through Empthrive. You agree that the transaction will appear on your statement with the name of the entity responsible for fulfilling the service, either Empthrive or a Partner, as specified at the time of your service request submission.
Empthrive uses third-party payment providers, including Stripe, to securely process payment transactions. By using Empthrive’s platform, you consent to the processing of your payment information by these third-party providers. These providers are fully compliant with applicable data protection laws, including the General Data Protection Regulation (GDPR) and the Payment Services Directive (PSD2), to ensure secure processing of payment information.
In the event of fraudulent or unauthorized use of payment information, Empthrive reserves the right to take necessary legal action. Please refer to the specific Partner's policies for any additional payment-related terms.

Refunds & Returns
Empthrive is committed to ensuring our customers' satisfaction with the services provided through the Empthrive platform. If you have concerns about the service you received, please contact us immediately with your service request number and a detailed explanation of the issue. You must notify Empthrive within 14 days of the scheduled service date to initiate a review request. We take such concerns seriously, and while we cannot offer refunds for services where the consultation was provided as agreed, we welcome your feedback for continuous improvement. In the case that a Partner falls short or does not provide the service as agreed, please note that Empthrive does not manage payments directly for Partner services, and therefore, we cannot issue refunds for these services. However, we will work with our Partners to address your experience and help improve the service for future consultations.

Refunds for consultation services are generally not applicable if the service was delivered as agreed, and the issue was not a result of failure on the part of Empthrive or the Partner.

If you experience an issue with a service provided by one of our Partners, you should first refer to the Partner’s terms and conditions for any additional remedies available. If unresolved, please reach out to Empthrive with any concerns about your experience, as we’re committed to working together with our Partners to continuously improve and ensure a high standard of service.

Effective Date
These Empthrive Checkout Order Request Terms are effective as of: February 28, 2025.
